Title 42 Sec 209 of the U.S. Code gives federal agencies the authority to appoint highly qualified scientists and engineers at a pay scale outside civil service laws in Title 5. The flexibility of the Title 42 hiring program allows federal agencies to compete with industry and academia to fill critical positions.
